Please
carefully read and understand these terms and conditions (“terms”), which
contain provisions that affect your legal rights.
By
installing, accessing or using any websites, mobile apps, email newsletters and
subscriptions, and other digital properties on which these terms are posted or
referenced (together, “online services”), you are entering into a binding
agreement with Oscar Master EAD ( “Oscar Master EAD”, “we” or “us”), which controls and operates the online
services from its headquarters at Ul Stefan Karadzha 10, Office n.4, 7002 Ruse Bulgaria.
By
accepting these terms, you also understand and consent to New
Generation Hostel Privacy, which is incorporated into, and part of, this agreement. Our Privacy
Statement describes how we collect, use and share information.
By accepting these terms, you understand and
agree to any Booking confirmation
and specific conditions set out in it, which is incorporated
into, and part of, this agreement.
In
these Terms, when we refer to “New Generation Hostel” or to "we",
"us" or "our", we mean New Generation Hostel Social
Enterprise, when we refer to "you" or "your", we mean you
as the Guest or the Booker on a Booking.
The
online services are not intended to be used by, or targeted to, anyone under
the age of 13 years old. You must be at least 13 years old to use the online
services. If you are at least 13 years old but not yet 18 years old (or the
legal age of majority if different in your jurisdiction), then you must review
these terms with your parent or guardian and they must understand and agree to
these terms in order for you to use the online services.
If
you or your parent or guardian do not agree to these terms, then you must
immediately stop using the online services and request that New Generation
Hostel close any online services account that you have created. You can request
account deletion by sending an email to contact.privacy@newgenerationhostel.com, please include the email address of the
account that you want to delete.
Obey the rules of the road.
Whenever
you use the online services, you must obey the rules of the road and all
applicable rules and regulations. You must not use the online services
while driving or while behind the wheel or controls of a vehicle that is moving
or not in “park”. In the interest of safety at all times, you should only use
the online services when it is lawful and safe to do so.
You are responsible for your devices and accounts.
You
are responsible for any devices, software and services needed to use the online
services. New Generation Hostel does not guarantee that the online services
will fully function on any device or with any software. You are also
responsible for any messaging and data charges, fees and taxes for your use of
the online services, including when we communicate with you by text, email or
other means that you choose. You may only use the online services with devices
that you own or control and using only the authorized operating system (e.g.,
Apple iPhone OS for Apple devices). If you create an online services account,
you are responsible for keeping the account secure and for all activity under
the account. You can only use one online services account and must keep your
account information accurate at all times.
New Generation Hostel right to update or terminate the
online services.
You
understand and consent that (with or without notice) New Generation Hostel may
update, modify or terminate the online services (or your access to them) from
time to time, including by pushing updates to (or removing functionality or
access from) any New Generation Hostel mobile app that you have installed on
your device.
Updates to these terms.
New
Generation Hostel may also update these terms at any time and at its sole
discretion. If New Generation Hostel makes material changes to the terms, we
will notify you by any reasonable means such as by posting the new terms in the
online service. If you do not agree to the changed terms, then you must
immediately stop using the online services and request that New Generation
Hostel close any online services account that you have created. To close your
account, you can contact us at contact.privacy@newgenerationhostel.com.
Availability of accommodations and services.
New Generation Hostel accommodations and services are
available in many parts of the world. However, the online services may describe
accommodations and services that are not available worldwide.
Links to job opportunities from the online services.
The
online services may provide links to job opportunities which are with the
hostel alone and not with New Generation Hostel. This means that the hostel
that posted the opportunity is alone responsible for setting the job
requirements, all hiring decisions, and all other employment related matters in
its business. New Generation hostel does not receive a copy of any application
you submit to a hostel, neither controls whether you receive an interview or
are hired, and neither controls employment policies nor practices.
2. Our Information Practices And Communications With
You.
These
terms incorporate New Generation Hostel Privacy
Statement as part of the terms. Our Privacy
Statement describes our information
practices, including how we collect, use and share information.
How we communicate with you.
Through
the online services, you may opt in to receive emails, text messages to the
mobile number you provide to us or push notifications from New Generation
Hostel. When you opt in to any of these types of communications, you understand
and consent that that you will receive marketing, transactional and other
messages. New Generation Hostel may use the information you have provided to us, to communicate with you
in accordance with New
Generation Hostel Privacy Statement.
Correspondence And Communication.
By completing a Booking, you agree to receive:

an email which we may send you shortly
prior to your arrival date, giving you information on your destination and
providing you with certain information and offers relevant to your Booking and
destination;
·
an email, or multiple emails (if you
booked for yourself and other people) which link to the online check-in;
·
an email after you have made a Booking
if payment fails or is reversed for any reason;
·
an email after arrival to rate your trip
experience;
·
and an email which we may send to you
promptly after your stay inviting you to complete our guest review form.
In order to duly complete and secure your Booking, you need to use your
correct email address. We are not responsible or liable for (and have no
obligation to verify) any wrong or misspelled email address, or inaccurate or
wrong (mobile) phone number or credit card number.
If you think you have made a Booking but have not
received a Booking Reference or a Booking Confirmation, please contact us.

When making a reservation, you are directly linked to the hostel’s booking
engine of your choice. The Booking online communications are
with the hostel alone and not with New Generation Hostel.
This means that the hostel that posted the availability is alone
responsible for any communication with you, and all other bookings
related matters in its business. New Generation hostel does not receive a copy
of any reservation you submit to a hostel, neither controls any
communication between you and the hostel.
New Generation Hostel disclaims
any liability or responsibility for any communication by or with the
hostel. New Generation Hostel cannot guarantee that any request or communication will be (duly and
timely) received/read by, complied with, executed, or accepted by the hostel.
Opting out of communications generally.
You
have a choice in how we communicate with you. You can generally find your communication
preferences with instructions on how to opt out in the profile Section of the
online service that you use. You may also change your communication preferences
using your device settings. In addition, our communications themselves may
include the opportunity to opt out. You understand and agree that you may need
to separately manage your communication preferences for each communication
method. For example, if you opt out of receiving marketing emails, you may
still receive marketing text messages if you’ve opted in to receiving them.
While we do our best to offer convenient methods for you to manage your
communications preferences, you may need to separately adjust your preferences
for each online service. Please note that for some account-related and
transactional communications, the only way to stop receiving these
communications may be to close your online services account. Lastly, please
note that if you are receiving communications from a hostel franchisee, then
you will need to opt out from them directly.
3. About Your Purchases.
About extra amenities.
All
extra amenities items are subject to availability at the hostels where you are
spending your journey. Some hostels do not sell all products. Images of items
and packaging on the online services are examples only and may not be identical
to the product or packaging you receive from a hostel. Differences may be due
to your device’s display of colors or factors such as the supplier and the
region of the country.

About Bookings.
New
Generation Hostel is a digital company.
New
Generation Hostel and the hostels do not accept cash.
Guests
are required to register an online services account in order to reserve a bed.
All
Bookings must be made by someone over the age of 18.
A Booker can make a Booking on behalf of other Guests,
provided that the Booker must accept these Terms on behalf of all the Guests,
take responsibility for managing and passing on any communications about the
Booking, and including these Terms, to all Guests on the Booking. If the Booker
is not a Guest, will have to provide us with the email and phone number of the
main Guest, so we can contact them directly in the event of any disruption to
their reservation, such as cancellations. The Booker must have the consent of
each Guests to receive any refund (where applicable) due under the Booking; and
acknowledge that any other Guests on the Booking may make subsequent changes to
it.
Before
you submit a request, you must register a credit card or debit card (either
one, a “payment card”) to use with your purchases. Guests are required to show
a credit card upon arrival at the reception desk.
Registering your payment method.
New
Generation Hostel and the hostels use third party providers to securely store
your payment card information and process your payments to hostels. You
understand and agree that, when you register a payment card, New Generation
Hostel or its third-party providers, may verify that the payment card you
registered is valid. You also understand and agree that when you use ordering
to make a purchase from a hostel, that hostel will be the merchant of record.
hostels may require information other than your booking reference, or voucher,
to verify your purchase. You represent and warrant that you are of sufficient
age and have all legal rights to use all payment cards you register.
Payment.
Unless stated otherwise, the Booker must pay in full
at the time of making your Booking.
Payment methods may differ depending on the Website,
App or sales channel you are using.
Your bank or card issuer may charge you foreign
currency or other transaction fees. We are not responsible for these fees.
We may process your payment otherwise than in real
time. If payment fails or is reversed for any reason after you have made a
Booking, we may need to contact the Booker to request that payment is
completed. If we do not receive payment in full either within 24 hours from the
time of Booking, or at least six hours prior to arrival (whichever is sooner),
we may cancel the Booking.
We only accept payment by credit card at the hostel.
Currency.
Rates are payable in the currency shown at the time of
Booking. If you add any extras or make changes online or by phone, you will be
charged fees in the same currency as your original Booking. If you do this at
the hostel, we will charge you fees in the local currency.
Taxes and Charges.
When you make a Booking, the applicable Government Tax
is passed onto you and must be settled.
In addition, each hostel independently applies any
other taxes and fees as required by law.
In the unlikely event that the Government Tax
increases after you have made a Booking, the hostel may require you to pay the
excess.
Security Deposit.
New Generation Hostel and the hostels
reserve the right to recover from any additional costs incurred as a result of
your misconduct, breach or non-compliance with relevant requirements. For this
reason, €20 security deposit must be pre-authorized by credit card, either
before arrival, or upon arrival at the hostel reception desk. The security
deposit will be automatically canceled at check-out, if no damage is found.
About the prices.
Unless
stated otherwise, rates are for your specific bed only. Rates cover bed
reservation only and do not include any other extras.
Certain
offers and pricing may not be available for all locations.
4. Deals.
You
have the possibility of receiving deals through the online services.
The
following general terms apply to the deals:
1. the deal may only be available through that particular online service
and for the product shown and subject to availability, in participating hostels
only, and until the expiration date;
2. unless stated otherwise each deal expires on redemption;
3. only one deal can be used per hostel visit;
4.
deals are not transferable;
5. there is no cash alternative;
6. there may be specific terms that apply to the deal which are stated on
the website next to the deal, and
7.
not all deals may be combined with
accommodations.
5. Making a Reservation.
When completing the purchase process, a Booking Reference is generated,
and it is treated as a contract between New Generation Hostel and the Booker.
If you think you have made a Booking but have not received a Booking
Reference or Booking Confirmation, please contact our
Booking department at booking@newgenerationhostel.com.
Booking for a large group.
You
can make a standard Booking for up to 45 Guests on our website. Alternatively,
to assist with making Bookings for groups of 46 or more Guests, we offer a
dedicated Group Bookings team. Bookings made through this dedicated
team may be subject to specific fees.
6. Bed Accommodations.
We operate an automated allocation accommodation system.
If you require a specific bed (upper/bottom/loft bed)
your request is subject to a fee and availability: you can contact our Booking
department at booking@newgenerationhostel.com at the time of Booking or afterwards online. The fee varies depending
on the bed category. Some of our bed categories include other benefits such as
Fully Made Bed, Traditional Italian Breakfast, and Towels, Soap and Shower Gel.
Please see our Fees
and Charges Policy for a complete overview. If you make
a reservation for yourself and other Guests, our system will try to allocate
all beds in your Booking close to other Guests on the same reservation, but
this depends on availability and it is not guaranteed. You can require
allocating all members in your Booking in the same room for a fee, by
contacting our Booking department at booking@newgenerationhostel.com at the time of Booking or afterwards online. If you choose to select
your bed, you must do so for all Guests on your Booking. Please see our Fees
and Charges Policy for more details.
All beds are subject to availability.
If you choose not to select a bed, we will allocate one
for you automatically when your booking is confirmed.
All bed fees are non-refundable. If you change your
arrival date and have paid for a bed on your original dates, we will try to
offer you an equivalent bed on your new arrival time. If the new bed fee is
higher than your original bed fee, you will need to pay the extra to select it.
If the equivalent bed is not available, or you prefer another bed, or you do
not want to select one, you will not be entitled to a refund.
We reserve the right to amend your bed selection, whether
before travel or if you are already checked-in, for operational or safety
reasons.
7. Making Changes To Your Booking.
Our change fees are clearly listed in our Fees
and Charges Policy.
Changing your reservation.
You can change your Booking to another available date
if you pay the Booking Change Fee plus the rate difference, if any,
for your new reservation. This is calculated when you make the change. If the
new rate is lower than the original rate, we will not refund you the
difference.
Guest changes.
You can change the name of a guest on a Booking to
someone else by paying a Name Change Fee.
You cannot resell your reservation to someone else. We
reserve the right to cancel any Booking, without a refund, if we reasonably
believe it may have been resold or made available for resale (including, but
not limited to, via any online marketplace).
Spelling mistakes.
It is important that your name is spelt correctly on
your Booking Confirmation and on-line check-in and that it matches the name on
your travel document (with picture i.d.). If it is not, you will need to
correct it as soon as possible.
You can do this on our website (for changes of up to
three characters only). If you cannot make the correction online, you can
contact our Customer Services Team. We will not charge you to do this, as long
as we reasonably believe you are correcting a mistake and not trying to change
the Booking to someone else.
How to make changes.
Our change fees depend on when the change is
made and which channel you use to make the change. You can make changes:

on our Website or via our App, at least
6 hours before arrival;
·
by speaking to our Customer Services
Team, at least 3 hours before arrival.
The time limits set out in this Section are based on
the arrival time of your original Booking or the reservation you wish to change
to, whichever is earlier.
Changing documents details.
You can change travel document details, if you have
replaced or lost your passport for example, in Manage Bookings.
Once you’ve checked-in, any changes must be made
through the website. Select the Guest you want to make changes for and
amend their details.
You are solely responsible for checking and complying
with all Applicable Laws and document requirements of any countries you are
travelling to, from or through.
We shall not be liable to you in connection with obtaining
necessary documents or your failure to comply with Applicable Laws,
requirements or these Terms.
Your submission of your online check-in, does not mean
that you are accepted or eligible to enter the hostel. We reserve the right to
refuse hosting any Guest we reasonably believe has not complied with, or whose
documents we reasonably believe do not comply with, such requirements, or where
we are instructed by government authorities to do so.
Additional Services.
If you have booked Additional Services for
your trip - such as extra amenities, you are responsible for making any
necessary changes to those services if your reservations change. We are not
responsible for those other changes.
Cancellations of Bookings for certain behaviors.
We
reserve the right to cancel your stay or Bookings connected to you, deny you
check-in or take other action to protect us and our systems, with or without
prior notice to you, if:
·
you cannot provide, upon request, contact
information for the cardholder in order for us to carry out security checks;
·
the cardholder did not authorize or
disputes the authorization of the payment and/or
claims that the Booking is fraudulent;
·
you have not paid (or the Booker has not
paid on your behalf) the appropriate rates, deposit, or any other outstanding
charges related to your Booking;
·
we reasonably suspect that the Booking,
or any information provided in relation to the Booking (whether provided by the
cardholder, the Booker or a Guest) is fraudulent, deceptive or inaccurate;
and/or
·
we reasonably suspect that the
cardholder, Booker or any Guest on the Booking, is connected to any other
fraudulent activity.
8. Online Check-in And Guest Information.
We are an online check-in only hostel.
Check-in opens at the moment of Booking confirmation.
Prior to arriving at the hostel, you must check-in
online and save. You must ensure the information submitted is accurate and you
must update it, if it changes. You must check-in at the reception desk showing
the documents you have submitted when checking-in online. For more details please see our Fees
and Charges Policy.
Please see the website for details about online
check-in.
If you change any details of your reservation(s) –
like changing your travel document – after checking-in online, you will need to
check-in online again and update your booking.
If
you have booked for yourself and other Guests, you will receive as many emails
as the number of beds booked related to your reservation.
If you have any technical issues while checking-in
online, please try again later. If you continue to have difficulties, please
seek assistance at support@newgenerationhostel.com.
9. Travel Documents And Other Requirements.
We require all Guests to provide photographic ID at
check-in at the hostel.
Children under the age of 18 must show photographic ID
– please see Section 11 (Travelling With Children And Infants)
Here are a few examples of photographic ID accepted
for national/international travelers:

A valid passport
·
Valid photographic EU or Swiss national
identity card
·
Valid photographic driving license,
provisional or full
·
Valid armed forces identity card
·
Valid police warrant card/badge
10.
Hostel Procedures.
Check-in
time.
Check-in at the hostel starts at 2.00 p.m.
If on the day of your arrival at the hostel, you would
like to enter your accommodation at an early time, you can check availability
for Early Check-in, by contacting our Booking department
at booking@newgenerationhostel.com at the time of Booking, afterwards online, or upon arrival at the hostel. Please
see our Fees
and Charges Policy for
more details.
Early Check-in allows Guests to check-in at the hostel
at any time from 3 a.m. up until 2 p.m.
Arrival at the hostel.
All Guests are required to show a credit card upon
arrival at the reception desk.
Check-in time at the hostel is at 2 p.m.
Once at the reception desk in the hostel, you will
have to:
·
Show your travelling document – please
see Section 9 (Travel Documents and Other Requirements)
·
Complete payment of all required
government taxes;
·
Pre-authorize security deposit, if you
did not settle it before arrival – please see Section 3 and Section 14;
·
If you did not check-in online – please
see our Fees
and Charges Policy and Section 8.
At the reception desk at the hostel, you will be given a
keychain containing your room key and your locker key. The number on your
keychain corresponds to the room, the bed and the locker number.
Your Keychain.
At the reception you will be given a keychain with 2
keys, containing your room key and your locker key. Pay attention that the 2
keys have different shapes.
Keys must be inserted completely into the lock before
turning it and opening the door.
You must pay attention that, if one of the keys does not
enter, or does not turn into the lock, you may be using the wrong key.
Do not force the key and try the other one. If you still
can’t open the door, call one of the Welcome Crew Team members in the hostel,
which will provide assistance.
If you fail to do so, and the key brakes
into the lock, you may be subject to specific fees, which you must pay
immediately. The fee varies depending on the door category. For more details

and Charges Policy.
You are responsible for your keys at all
times for the entire period of your stay at the hostel and must return the
keychain intact to the reception desk at check-out. If you fail to return the
keychain, or if you return it, but there are missing or broken keys, you are
subject to specific fees, which you must pay immediately. The fee varies
depending on the door category. For more details please see our Fees
and Charges Policy.
Taking place in your room.
Once in your room, you will have to look for your bed
number, which is the same of the locker number assigned to you.
If you occupy the wrong bed, or decide to
change bed arbitrarily, you are subject to a fee, which you must pay
immediately. For more details please see Fees
and Charges Policy.
Lockers.
Lockers are burglar
proof. The only way to open your locker, is with your key.
A keychain will be given to you, containing your room key
and your locker key.
Check-out time.
Check-out time is at 11 a.m.
If on the day of your check-out, you would like to
leave your accommodation at a later time, you can check availability for Late
Check-out by contacting our Booking department
at booking@newgenerationhostel.com at the time of Booking, afterwards online, or at the hostel up until
the day before your scheduled departure. Please

more details.
Late Check-out allows Guests to check-out from the
hostel up until 2 p.m.
After 2 p.m., if you fail to check-out in time, you are subject to a fee, which you must pay immediately. For more details
please see Fees
and Charges Policy.
11. Travelling With Children And Infants.
For the purposes of these Terms, an "Infant"
is a child under the age of two years old on the date of the check-in and a
"Child" is a child over the age of two years old and under the age of
18 years old on the date of the arrival.
We do not host Infants who are less than 2 years old
on the date of the check-in.
We only host Children if travelling with an
Accompanying Adult, or have the written permission signed, along with proof of
document certifying they are Parents or Legal Guardians. Please contact our
Booking department, if you need to add a Child to your Booking.
Children must have a separate bed. Reservations for
Children are charged at our normal rate, but the Government Tax may
differ.
If you are travelling with a Child, you must always
take full responsibility for them throughout your journey. Under no
circumstance may you ask a Guest who is not on your Booking to accept
responsibility before or during your stay for a Child.
Document requirements for Children may vary from
country to country.
It is your responsibility to ensure that all Guests on
the Booking are properly documented.
12. Guests Requiring Special Assistance.
If you have special assistance requirements in
relation to a disability or a medical condition, please make sure you let us
know your requirements at the time of making your Booking, or contact our Booking department at booking@newgenerationhostel.com, before making the reservation.
13. Refunds.
Our rates and fees are non-refundable,
so if you cancel, or miss your reservation you will not receive a refund,
except as stated in these Terms.
Cancellations within 24 hours of making the Booking.
If you cancel your Booking in full within 24 hours of
making the Booking, we will give you a full refund minus the Cancellation Fee
listed in our Fees
and Charges. You
can make this cancellation online or by calling our Customer Services team. If
you booked through an Agent, you must ask them to do this for you.
However, please note that you are unable
to cancel your Booking less than 6 hours before the scheduled date of check-in
(even if within 24 hours of making the Booking).
Method of refund.
We will only pay refunds to the Booker using the
original payment method. If the original payment method is no longer available,
we will refund to an alternative payment method in the Booker’s name. If you
have booked through an Agent, they will be responsible for passing on any
refund to you. We are not responsible for any fees the Agent may apply for
processing the refund.
A refund made to someone presenting themselves to us
as the Booker using the necessary Booking and security details, and who we
reasonably believe is the Booker, will be deemed a proper refund and we will
not process any further claim for a refund by the Booker or any other Guest on
the Booking.
Refunds will normally be made in the
original currency in which the Booking was made.
14. Right
to Refuse Hosting.
We may refuse to host you and/or your
Baggage, remove you from a hostel even if you have already checked-in, we may
cancel any existing or subsequent Bookings (and no refunds will be paid in such
circumstances), without any liability on our part, if:
·
you or your Baggage may put the safety
of the hostel or the health or safety of any person in the hostel in danger or
at risk;
·
you are drunk or under the influence of
alcohol or drugs in the hostel;
·
you have smoked or attempted to smoke in
the hostel (other than in permitted areas), in this case you are also subjected
to pay a fee. Please see our Fees
and Charges Policy for more details.
·
you are, or there is good reason to
believe you are, in unlawful possession of drugs;
·
your mental or physical state is a
danger or risk to yourself, the hostel, or any other person in it;
·
you have caused harm to, injured, or
used threatening, abusive, insulting, obscene or lewd language or behavior
towards a member of our staff, or any Guests;
·
you have committed a criminal offence
during the Booking process, the check-in process, or in the hostel;
·
you are a hazard or risk to yourself or
other persons or to property;
·
we are instructed to do so by government
authorities (including in relation to your guest Information);
or
if any documentation presented by you:
·
has been acquired unlawfully;
·
has been reported as being lost or
stolen;
·
is counterfeit or the subject of payment
fraud;
·
has been altered by anyone other than
us;
·
has been mutilated;
·
you are not properly documented at all,
or
if you refuse to pay:
·
taxes and fees as required by law,
or
if you refuse to pre-authorize:
·
the security deposit.
15. Ownership and Licenses for the online services.
New Generation Hostel intellectual property ownership.
Any
and all rights in the online services are and shall remain the exclusive
property of New Generation Hostel or its licensors. For purposes of clarity,
“online services” includes any and all content on the online services, such as,
but not limited to, text, images, graphics, logos, page headers, button icons,
images, audio clips, digital downloads, data compilations, software,
trademarks, service marks, trade dress, audio, video, data and other materials
(together, “content”) as well as any part of the online services. The online
services are licensed, not sold, to you. Nothing in these terms intends to
transfer any such rights to, or to vest any such rights in, you. You may not
take any action to jeopardize, limit or interfere with New Generation Hostel or
its licensors’ rights.
Your license to use the online services.
Subject
to these terms, you are granted a personal, non-exclusive, non-transferable and
revocable license to use the online services solely for your own personal,
non-commercial purposes and solely in accordance with these terms. For purposes
of clarity, “Use” includes access, interact with, and display. No licenses or
rights are granted to you by implication or otherwise, except for the licenses
and rights these terms expressly grant to you. New Generation Hostel reserves all
other rights.
Trademark information.
Trademarks,
service marks, and all graphical elements, including the look and feel
appearing on the online services, are distinctive and protected trademarks or
trade dress of New Generation Hostel or its licensors. The online services may
also contain various third-party names, trademarks, and service marks that are
the property of their respective owners.
16. User submissions and unsolicited ideas.
User submissions.
Some
online services may allow you to send comments, remarks, suggestions, ideas,
graphics, photographs, questions, complaints or other information posted or
communicated to New Generation Hostel through the online services (together,
“submissions”). You understand that by submitting any information to New
Generation Hostel through the online services, you grant New Generation Hostel
a perpetual, irrevocable, worldwide, non-exclusive, royalty-free, transferable
license to use, reproduce, distribute, sublicense to others, modify, translate,
prepare derivative works of, publicly display, and publicly perform the
submissions, including to use them for any commercial or other purpose
whatsoever without approval from or compensation to you or any other person,
including to use them for any commercial or other purpose whatsoever without
approval from or compensation to you or any other person. New Generation Hostel
will not be required to treat any submissions as confidential.
Unsolicited ideas.
It is New Generation Hostel policy not to consider unsolicited ideas.
While we appreciate you taking the time to consider New Generation Hostel, we
are unable to review new ideas from outside the New Generation Hostel system.
You expressly waive any and all claims against New Generation Hostel and all
other Members of the New Generation Hostel System in connection with New
Generation Hostel consideration, use or development of any product, design,
concept or other materials similar or identical to your submission now or in
the future. Please see New Generation Hostel FAQs for more information.
17. Limitations On Liability And Disclaimers.
Limitations on New Generation Hostel liability.
Neither
New Generation Hostel, nor any other Members of the New Generation Hostel
System shall be liable for any direct or indirect lost profits or lost business
damage, special, indirect, consequential, exemplary or incidental damages,
including lost data, personal injury or property damage related to or arising
out of the online services. Nothing in this Section is intended to limit New
Generation Hostel liability for damages to the extent caused by New Generation
Hostel own gross negligence or intentional or unlawful misconduct.
Additionally, nothing in this Section is intended to limit or alter your rights
as a consumer that cannot be limited or altered under applicable law. New
Generation Hostel reserves all legal rights to recover damages or other
compensation under these terms or as allowed by law.
New Generation Hostel provides the online services
“AS-IS” and without any warranties.
The
online services may include inaccuracies or errors. New Generation Hostel
provides the online services “as is” and without warranties of any kind either
expressed or implied. New Generation Hostel disclaims all warranties of
merchantability and fitness or a particular purpose. New Generation Hostel does
not warrant or make any representation that the online services will be
accurate, reliable, uninterrupted or error-free, that defects will be
corrected, or that the online services are free of viruses or other harmful
components. You assume total responsibility related to your use of the online
services. Your sole remedy against New Generation Hostel for dissatisfaction
with the online services is to stop using them. This limitation of relief is a
part of the bargain between the parties. These warranty exclusions may not
apply to you to the extent that applicable law does not allow the exclusion of
implied warranties.
Events beyond our control.
New
Generation Hostel have no responsibility for failure to perform any of its
obligations under these terms caused by or related to any event beyond New
Generation Hostel reasonable control. If such an event occurs, then New
Generation Hostel obligations under these terms will be suspended for the
duration of the event; and New Generation Hostel may, but is not required to,
use reasonable endeavors to find a solution by which its obligations under
these terms may be performed despite the event.
How we settle disputes.
These
terms and conditions and the provision of our services shall be governed by and
construed in accordance with Italian law. Nevertheless, the foregoing choice of
law, can rely on the mandatory terms of the law of the country where they have
their habitual residence.
18. Acceptable uses and restrictions for the online
services.
Acceptable uses and other restrictions.
With
respect to the online services (which includes content), you may not, and may
not allow third parties, to:
1. Use the online services for any purpose that is unlawful or prohibited
by these terms;
2. Delete or change any copyright, trademark, or other proprietary notices;
3. Attempt to obtain ownership or title to the online services, including
the content;
4. Use, copy, distribute, republish, display, disclose, upload, post, or
transmit the online services in any commercial manner;
5. Rent, lease, sell, sub-license, loan, translate, merge, adapt, assign or
transfer the online services, or combine them with, or incorporate them into,
any other programs or services;
6. Disassemble, decompile, reverse-engineer, copy in source or object code
format, or create derivative works based on the online services;
7. Use or launch any unauthorized technology or automated system to access
the online services or extract content from the online services, including but
not limited to spiders, robots, screen scrapers, or offline readers;
8.
Attempt to disable, damage, overburden,
impair or gain unauthorized access to the online services, New Generation
Hostel network or any user accounts associated with the online services.
19.
Miscellaneous.

New Generation Hostel makes no
representation that the online services are appropriate or available outside of
Europe. If you use the online services from other locations, you are
responsible for compliance with applicable local laws.

These terms will be governed and
interpreted pursuant to the laws of Italy, notwithstanding any principles of
conflicts of law.

Although these terms govern the online
services as between New Generation Hostel and you only (nor any other Members
of the New Generation Hostel System are parties to these terms), all other
Members of the New Generation Hostel System are third party beneficiaries under
these terms and will have the right to enforce against you those rights that
New Generation Hostel holds under these terms to the extent such terms may
pertain to them; there are no other third beneficiaries under these terms.

The terms are written in English (US).
Any translation of the terms into another language is provided solely for your
convenience, and to the extent there is any conflict between the two, the
English (US) version controls.

On termination of these terms or of your
permission to use the online services, all rights granted to you under terms
shall cease; however, these terms will continue to apply to your prior use of
the online services and anything relating to or arising from such use. Upon
termination, all rights of New Generation Hostel and other Members of the New
Generation Hostel System, including all intellectual property rights, proprietary
rights, and licenses in these terms shall survive, as well as all restrictions
on use, all limitations on liability and disclaimers, and all of Section 17
(“How we settle disputes”).

Each of the terms and conditions in
these terms are severable and operate separately. If any of them are unlawful,
void or unenforceable, then the remaining terms and conditions will remain in
full force and effect.

If New Generation Hostel fails to insist
that you perform any of your obligations under these terms, or if New Generation
Hostel does not enforce its rights against you, or delays in doing so, that
will not mean that New Generation Hostel has waived its rights against you and
will not mean that you do not have to comply with those obligations.

New Generation Hostel may transfer its
rights and obligations under these terms to another organization or entity, but
this will not affect your rights or our obligations under these terms. You may
only transfer your rights or obligations under these terms to another person if
New Generation Hostel agrees in writing.
